குருக்கள்மடம் மனிதப் புதைகுழி வழக்கில் திருப்புமுனை -நீதிமன்ற உத்தரவின் விபரம்

குருக்கள்மடம் மனிதப் புதைகுழி வழக்கில் காணாமல் போன ஆட்கள் பற்றிய அலுவலகம் மற்றும் சட்டமா அதிபருக்கு மன்றில் முன்னிலையாகுமாறு அறிவித்தல். பாறுக் ஷிஹான் 1990.07.12 ஆந் திகதி புனித ஹஜ் கடமையை நிறைவு செய்து வீடு திரும்பிய யாத்திரிகர்கள் மற்றும் வியாபாரிகள் கல்முனை - மட்டக்களப்பு வீதியில் குருக்கள்மடம் எனும் இடத்தில் கடத்திக் காணாமலாக்கப்பட்டு கொலை செய்யப்பட்டு புதைக்கப்படட்டமை தொடர்பில் பாதிக்கப்பட்ட அப்துல் மஜீத் அப்துல் ரவூப் என்பவரால் களுவாஞ்சிக்குடி பொலிஸாருக்கு முறைப்பாடு மேற்கொள்ளப்பட்டிருந்தது. அதனடிப்படையில் கடந்த 2014 ஆம் ஆண்டு  களுவாஞ்சிக்குடி சுற்றுலா நீதிமன்றில் தாக்கல் செய்யப்பட்ட வழக்கில் கெளரவ நீதிவான் அவர்கள் குறித்த சந்தேகத்திற்கிடமான மனிதப்புதைகுழி அமைந்துள்ளதாக நியாயமாக சந்தேகிக்கப்படும் இடத்தைத் தோண்டுவதற்கான பூர்வாங்க நடவடிக்கைகளை மேற்கொண்டு மன்றுக்கு அறிக்கையிடுமாறு உரிய அரச திணைக்களங்கள் மற்றும் நிறுவனங்களுக்கு கட்டளையாக்கி இருந்தார். அதனடிப்படையில் நில அளவைத் திணைக்களம், புவிச்சரிதவியல் அளவை மற்றும் சுரங்கங்கள் பணியகம், தொல்லியல் திணைக்களம், காணாமல் போன ஆட்கள் பற்றிய அலுவலகம், தடயவியல் மருத்துவம் மற்றும் நஞ்சியல் நிறுவகம் என்பன தமது ஆய்வுகளை மேற்கொண்டு குறித்த சந்தேகத்திற்கிடமான மனிதப் புதைகுழி அமைந்துள்ளதாக நியாயமாகச் சந்தேகிக்கப்படும் இடத்தைத் தோண்டுவதற்கான பூர்வாங்க நடவடிக்கைகளை முடிவுறுத்தி  மன்றுக்கு திட்ட வரைபையும் சமர்ப்பித்திருந்தனர். இந்நிலையில்,  மன்றுக்கு சமர்ப்பணங்களை மேற்கொண்டிருந்த களுவாஞ்சிக்குடி பொலிஸார் குறித்த விடயம் தொடர்பில்   சட்டமா அதிபரின் ஆலோசனையைப் பெற்று அதனை   நீதிமன்றுக்கு அறிவிப்பதற்குத் தவணையொன்றை வழங்குமாறு   மன்றுக்குத் தெரிவித்திருந்தனர். அதன் பிரகாரம், 04.10.2020 இல்   சட்டமா அதிபரினால் களுவாஞ்சிக்குடி பொலிஸாருக்கு வழங்கப்பட்ட ஆலோசனைக்கு அமைவாக குறித்த வழக்கானது கிடப்பிலிடப்பட்டிருந்தது. இப்பின்னணியிலேயே இவ்வழக்கின் முறைப்பாட்டாளரின் அறிவுறுத்தலுக்கு அமைவாக 11.07.2025 ஆந் திகதியாகிய இன்று குரல்கள் இயக்கத்தின் சட்டத்தரணியால் களுவாஞ்சிக்குடி நீதிவான் நீதிமன்றில் தாக்கல் செய்யப்பட நகர்த்தல் பத்திரம் மூலம் குறித்த வழக்கானது திறந்த மன்றில் அழைக்கப்பட்டது. இதன்போது முறைப்பாட்டாளர் சார்பில் மன்றில் முன்னிலையாகி இருந்த சட்டத்தரணிகளின் சமர்ப்பணம் மற்றும் வழக்கேட்டை மிக நுணுக்கமாக ஆராய்ந்த  நீதிமன்றமானது முறைப்பாட்டாளரின் முறைப்பாடானது நீதிமுறையாக அணுகப்படாமல் நிலுவையாக உள்ளமையானது நீதியின்பாற்பட்டதல்ல எனும் அடிப்படையில் குறித்த வழக்கை எதிர்வரும் 21.07.2025 க்கு தவணையிடுவதாகவும் குறித்த தினத்தில்  மன்றில் முன்னிலையாகுமாறு   சட்டமா அதிபருக்கும், காணாமல்போன ஆட்கள் பற்றிய அலுவலகத்துக்கும் களுவாஞ்சிக்குடி பொலிசாருக்கும் அறிவித்தல் அனுப்புமாறு கட்டளை ஆக்கியுள்ளார். குறித்த இவ்வழக்கில் முறைப்பாட்டாளர் சார்பில் குரல்கள் இயக்கத்தின் சட்டத்தரணிகளான முஹைமீன் காலித் , முபாறக் முஅஸ்ஸம் ஆகியோர் மன்றில் தோன்றி இருந்தனர். Kaluwanchikudy Magistrate Notices to parties in relation to Kurukkalmadam Mass Grave Case after 35 years.    On 12.07 1990, pilgrims returning home after performing the Hajj and traders travelling along the Kalmunai–Batticaloa road were allegedly abducted, killed, and buried in a mass grave at Kurukkalmadam. A complaint regarding this incident was lodged with the Kaluwanchikudy Police by Mr. Abdul Majeed Abdul Rauf, one of the affected parties. Based on this complaint, in the year 2014, a case was filed before the Honourable Kaluwanchikudy Magistrate’s Court. The Honourable Magistrate, having considered the matter, ordered the relevant government departments and institutions to carry out preliminary procedures to excavate the suspected mass grave site and report to the court. In compliance with this directive, the Department of Survey, the Geological and Mines Bureau, the Department of Archaeology, the Office on Missing Persons, and the Department of Forensic Medicine and Toxicology carried out their respective investigations. These authorities completed the preliminary procedures and submitted a draft proposal to the Honourable Court for the excavation of the area reasonably suspected to be a mass grave. Subsequently, the Kaluwanchikudy Police informed the Honourable Court that they sought legal advice from the Honourable Attorney General regarding the matter and moved for a date to report back to court. Based on the advice issued by the Honourable Attorney General to the Kaluwanchikudy Police on 04.10.2020, the case was placed under pending status . In this background, as per the instructions given by the complainant, the counsels representing the Voices Movement filed a  motion before the Honourable Kaluwanchikudy Magistrate’s Court on 11.07.2025, requesting that the case be called in the open court. Upon hearing the comprehensive submissions made on behalf of the complainant and after a detailed review of the case records, the Honourable Court observed that the complaint had not been duly addressed through appropriate legal procedure and that the prolonged delay was contrary to the principles of justice. Accordingly, the Court postponed the matter to 21.07.2025 and issued directions for the Honourable Attorney General, the Office on Missing Persons, and the Kaluwanchikudy Police to appear before the Court on that date. In this case, Attorneys-at-Law Mr. Muhaimeen Khalid and Mr. Mubarak Muazzam appeared on behalf of the complainant, representing the Voices Movement. --
